I am saying that free speech minimizes the number of considerations judges have to make. Under your system, they would be able to decide if calling someone a fascist was an insult.

i agree free speech can get ugly. I am fond of saying that the problem with free speech is you have to defend the right to speak of people you really wish would shut the fuck up.
